Stewart, Transportation PlannerC� <br /> SUBJECT: Alleyway Vacation of Right-of-Way between East Street and North 16th Street <br /> SUMMARY RECOMMENDATION: Staff recommends approval of petition to vacate the <br /> alleyway between East Street and North 16th Street as indicated on the plat. The City Plan <br /> Commission voted 8-0 to recommend approval of this petition at the October 2, 2008 meeting; <br /> the minutes of the meeting are attached. <br /> BACKGROUND: The petitioner is requesting to vacate public rig t-of-way in the Alleyway <br /> between East Street and North 16th Street south of 1501 East Eldorado The vacation will enable <br /> the petitioner to install a fence to add much needed additional security. <br /> Swartz Management Corporatiori has been notified by the petitioner egarding the vacation and <br /> has no objections. The petitioner owns all other adjacent properties. <br /> Letters were sent to AmerenIP, Comcast Communications, and AT&T notifying the utility <br /> companies of the vacation request and no objections to the proposed right-of-way vacation have <br /> been expressed. An easement will be reserved for utility access. <br /> Because there is only one (1) licensed commercial appraiser in the City of Decatur, only one (1) <br /> appraisal was conducted on the property. The proposed vacated property has an estimated <br /> market value of$4,000 which will be paid to the City. <br /> POTENTIAL OBJECTION: There were no known objectors at the Plan Commission <br /> Meeting. <br /> INPUT FROM OTHER SOURCES: The alleyway vacation has b en reviewed by the City's <br /> Technical Review Committee; Planning, Engineering and Fire hav approved the proposed <br /> alleyway vacation. <br /> STAFF REFERENCE: Any additional questions may be forwarde to Joselyn A.
