' <br /> Excerpts from Plan Commission Minutes of September 4, 2008 <br /> Cal.No. 08-49 Petition of LAVELLE HLTNT to rezone property <br /> located at 3635 EAST US ROUTE 36 from B-1 <br /> Neighborhood Shoppi�g District to B-2 <br /> Commercial District. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Poland. <br /> Mrs. Stewart presented the recommendation of staf£ , ,, <br /> The subject site is located at 3635 East US Route 36 and contains applroximately 3.8 acres and is <br /> the old Eagle building located in Decatur Plaza. <br /> The petitioner proposes to rezone Lot Two (2) of Decatur Plaza from B-1, Neighborhood <br /> Shopping District to B-2, Commercial District in order to develop the property commercial with <br /> more intensive uses. <br /> The surrounding zoning includes B-2, Commercial District to the north; R-1, Single Family <br /> Residence District and R-3, Single Family Residence District to the south; B-1, Neighborhood <br /> Shopping District to the east; and R-2, Single Family Residence District and B-1, Neighborhood <br /> Shopping District to the west. The Decatur Urban Area Land Use Plan shows this area as <br /> Commercial. The proposed use is compatible with adjacent uses in the surrounding area. The <br /> rezoning should not have an adverse effect of the surrounding area� The previous use of the <br /> property was a Grocery store which was located at this particular site or a number of years and it <br /> did not appear to have had an adverse effect on the neighborhood. <br /> The rezoning and proposed commercial use is consistent with the i tent of the Comprehensive <br /> Plan and the Decatur Urban Area Land Use Plan. <br /> Staff recommends approval of the rezoning. <br /> Mr. John questioned why the entire area was not being zoned B-2�. Mrs. Stewart stated the <br /> petitioner only owns the area that is being zoned B-2. <br /> Mr. LaVelle Hunt, petitioner, was sworn in by Mrs. Poland. <br /> Mr. Hunt stated he was the owner of the property and the purpose of zoning the property to B-2 <br /> was to have storage inside the fence they will be putting up and expanding to the south. He also <br /> stated he did not have a chance to talk to other property owners about their properties being <br /> rezoned to B-2. <br /> There were no questions and no objectors present. <br /> It was moved and seconded(Livingston/Anderson)to forward Cal.Nq. 08-49 to the City Council <br /> with recommendation for approval as presented by staff. Motion carr ed unanimously. <br />
