No. 08-18 Petition of Dan Doughe y for a Conditional Use <br /> Permit in the 3800 Bl ck North Martin Luther <br /> King, Jr. Drive for an aut matic car wash. <br /> Ms. Ashe presented the recommendation of staff: I <br /> The subject site, zoned B-2, Commercial District is located in the 380 Block of North Martin <br /> Luther King, Jr. Drive, contains approximately 32,680 square feet and 's currently undeveloped. <br /> The petitioner is requesting a conditional use permit to allow for the c nstruction of a state of the <br /> art Rainstorm Car Wash. The proposed building will be 3,656 square eet in area. It will contain <br /> a single bay in which the vehicles will drive through. The drive up 1 will accommodate eight <br /> (8) vehicles which feed from two (2) lanes into one. Also on site,ther will be seven(7) vacuum <br /> stalls. <br /> Staff supports the proposed Conditional Use Permit. Staff believes th�'proposed use of a <br /> carwash on this particular lot is compatible with the surrounding B-2 z ning as well as the <br /> neighboring commercial uses. According to Section XXII.A.3. there e three standards which <br /> must be met in order to grant a conditional use permit. The first stand d requires that the use be <br /> "necessary for the public convenience at the location." The proposed se is generally compatible <br /> with the neighboring uses along Martin Luther King, Jr. Drive and pro ides a service which can <br /> be utilized by area residents. The proposed use also meets the second tandard. The facility is <br /> located and designed to be operated in a manner in which the public h alth, safety and welfare <br /> will be protected. Last, the facility does not appear it will cause subst tial injury to the value of <br /> other properties in the neighborhood as stated by the third standard. T e proposed carwash will <br /> be located next to a large gas station as well as next to an office wareh use building along Martin <br /> Luther King, Jr. Drive. The structure will be required to meet all appli able City codes and <br /> standards. <br /> The Conditional Use Permit has been reviewed by the City's Technica�Review Committee; '' <br /> Planning, Engineering, and Fire have all approved the proposed devel pment. <br /> Based on the above analysis, staff recommends approval of the petitio as submitted with the , <br /> following conditions: � ��I <br /> • The correct legal description is added to the Lighting Plan. I, �'I <br /> • The proposed Lighting Plan comes into compliance and meets�he current Zoning <br /> Ordinance. ' <br /> • The Landscaping Plan is approved pending the legal subdivision of the property. <br /> • Building permits will not be issued as proposed in the approvec�plan until the property is <br /> - legally subdivided. I <br /> Section XXII.A.2. requires the Plan Commission to hold a public he 'ng on a conditional use <br /> permit request, and then forward its report and recommendation to he City Council for final <br /> approval. A motion to forward Calendar Number 08-18 to t e City Council with a <br /> recommendation for approval is suggested. <br /> Mr. John Mickler asked if the nearby gas station had a carwash. Ms. she stated that it did have <br /> a carwash but the proposed carwash is a different owner. <br />
