No. 08-27 Petition of TREVOR S ALETS for a Conditional <br /> Use Permit at 2505 NO TH MAIN STREET. <br /> Mrs. Stewart presented the recommendation of staf£ <br /> The subject site is approximately 1.28 acres and is vacant. <br /> The subject petition requests a conditional use permit to allow the use of a drive-thru coffee <br /> facility. A drive-thru facility located in the B-1 District requires a C nditional Use Permit. The <br /> petitioner has requested rezoning to B-1 for a portion of the property. <br /> The petitioner plans to have a drive-thru coffee facility which will ave two drive-up windows <br /> for quick in and out service. There will be no inside sit down se ice provided. A walk-up <br /> window will be provided. <br /> The petitioner also plans on having an Automated Teller Machine ( TM) service located on the <br /> property which is an allowed use in a B-1 District. This ATM will nly have four (4) stacking <br /> spaces instead of five (5) as required by the Zoning Ordinance. <br /> Section XXII.A3. lists three standards which must be met in orde to grant a conditional use <br /> permit. The first standard requires the applicant to show that the use is "necessary for the public <br /> convenience at the location." The proposed use is generally compa ible with the neighborhood <br /> and provides a service which can be utilized by area residents. <br /> The proposed use also meets the second standard. The facility is ocated and designed to be <br /> operated in a manner that the public health, safety and welfare will be protected. <br /> This use also meets the third standard. The facility will not cause su stantial injury to the value <br /> of other properties in the neighborhood. Previously Bob's Roast Be f Restaurant was located at <br /> this particular site for a number of years and it did not appear to ha e had an adverse effect on <br /> the neighborhood. The structure will be required to meet all applicab e City codes and standards. <br /> The proposed commercial use is consistent with the intent of the Cpmprehensive Plan and the <br /> Decatur Urban Corridors Plan. <br /> Based on the above analysis, staff recommends approval of the conditional use permit as <br /> submitted with the following condition: site plans shall be submitt d to and approved by the <br /> Economic and Urban Development Department, the Depart ent of Engineering and <br /> Infrastructure and the Fire Department prior to the issuance of a build ng permit. <br /> Section XXII.A.2. requires the Plan Commission to hold a public h aring on a conditional use <br /> permit request, and then forward its report and recommendation to the City Council for final <br /> approval. A motion to forward Calendar Number 08-27 to he City Council with a <br /> recommendation for approval is suggested. <br /> Ms. Elayna Sadorua asked if in the future the owner desires to have a sit down area, would the <br /> parking allow for the change. Mrs. Stewart responded that the CUP ould have to be amended. <br /> Mr. Cochran stated the drive-up coffee facility will have two windo . There are many types of <br /> these facilities in central Illinois but not in Decatur. Mr. Cochran sta ed this will be a very small <br /> structure and will not accommodate sit down business.
