: �, <br /> Excerpts from Plan Commission Minutes of July 3,2008 <br /> Cal.No. 08-26 Petition of TREVOR S ALETS, to rezone property <br />� located in the 2500 BL CK OF NORTH CHURCH <br />; STREET from R-3 Single Family Residence <br /> District to B-1 Neighbo ood Shopping District. <br />' Mrs. Stewart presented the recommendation of staff: <br /> The subject site is located in the 2500 Block of North Church Street and contains approximately <br /> 0.73 acres and is a vacant lot. <br /> The petitioner proposes to rezone the five (5) lots from R-3, Single amily Residence District to <br /> B-1,Neighborhood Shopping District in order to develop the propert commercially. <br /> The surrounding zoning includes R-3, Single Family Residence Dis 'ct to the north, O-1, Office <br /> District to the south, B-1, Neighborhood Shopping District to the east and B-2, Commercial <br /> District to the west. The Decatur Urban Area Land Use Plan shows this area as a Low Density <br /> Residential and Commercial. The proposed use is compatible ith adjacent uses in the <br /> surrounding area. The rezoning should not have an adverse effect o the surrounding area. The <br /> previous use of the property was parking for Bob's Roast Beef Rest urant which was located at <br /> this particular site for a number of years and it did not appear to ha�e had an adverse effect on <br /> the neighborhood. <br /> The rezoning and proposed commercial use is consistent with the i tent of the Comprehensive <br /> Plan and the Decatur Urban Corridors Plan. <br /> Staff recommends approval of the rezoning. <br /> Section XXIX. requires the Plan Commission to hold a public hearin on a rezoning request, and <br /> then forward its report and recommendation to the City Council for nal approval. A motion to <br /> forward Calendar Number 08-26 to the City Council with a reco endation for approval is <br /> suggested. <br /> Mr. John Mickler asked if an alley was involved. Mrs. Stewart r sponded that it had been <br /> vacated. <br /> Mr. Phil Cochran, representative of Mr. and Mrs. Trevor Stalets, stat d the Stalets want to build <br /> and run a drive-up coffee facility which requires a B-1 District. <br /> There were no questions and no objectors were present. <br /> It was moved and seconded (Livingston/Peck) to forward Cal. No. b8-26 to the City Council <br /> with recommendation for approval as presented by staff. Motion carri d unanimously. <br />
