ECONOMIC AND URBAN DEVELOPMENT MEM RANDUM
Memo No. 08-61 '
May 14, 2008
TO: Honorable Mayor Paul Osborne and City Council
FROM: John A. Smith, Interim City Manager G
Greg C. Crowe, Assistant City Manage
Suzan Stickle, Senior Planner Sj
Stephanie Ashe, Historic Preservation Planne
SUBJECT: Request to rezone the lot from O-1, Office District to R-6, M ltiple Dwelling District
SUMMARY RECOMMENDATION: Staff recommends approval of the etition.
The City Plan Commission voted 7-0 to recommend approval of this petitio as presented at the May 1,
2008 hearing; the minutes of the meeting are attached. i
, BACKGROUND: ,
The subject site is located at 309 North Edward Street and contains approxi ately 12,400 square feet. The
property is currently developed with a large single family structure with an ttached garage. In the past the
structure has been used as a multi family residence.
The petitioner proposes to rezone the lot from O-1, Office District to R-6 Multiple Dwelling District in
order to, 1) reside in the main structure; 2) rent out the garage living qua ers and; 3) operate an interior
design consulting business as allowed by home occupation.
Staff supports the proposed rezoning as it is more compatible with the surr unding R-6 neighborhood than
the current Office District zoning. It is Staff's opinion that rezoning the pr perty to R-6 will provide more
appropriate uses of the property in the future and help to maintain the integrity of this structure and
property in the historic district.
Staff supports the use of the structure as a two family residence; one unit lo ated above the garage and the
other in the main structure. Staff is also of the opinion that running an inte 'or design consulting business
out of the basement under the home occupation rule will not inheren ly affect the property or the
surrounding neighborhood. Staff is of the opinion that the combination of ses will not increase the traffic
of the neighborhood nor increase the need for on street parking, as there i plenty of parking in the drive
way and garage. Additionally, ADA requirements for an office use woul require severe altering of the
historic features of the structure. As a residential structure, these requireme ts will not need to be met, thus
retaining the historic significance of the structure.
POTENTIAL OBJECTION: There were no known objectors at the Plan ommission meeting.
INPUT FROM OTHER SOURCES: N/A
STAFF REFERENCE: Any additional questions may be forwarded to Ste hanie Ashe at 424-2781 ar at
sa,lic(ii:decaturil.
