ECONOMIC AND URBAN DEVELOPMENT MEM RANDUM
Memo No. 07-76
June 13, 2007
TO: Honorable Mayor Paul Osborne and City Council
FROM: Steve Garm ity Manager
Greg C. Cro Director of Economic and Urban Develome I
Suzan Stickl , enior PlannerS
SUBJECT: Request to vacate an alleyway in the 400 Block of South ranklin Street
SUMMARY RECOMMENDATION: Staff recommends approval of the alleyway vacation
petition.
The formal vacation of this alleyway will not have an adverse affect on the general public. Staff is of
the opinion that the best interests of the City of Decatur would be se ed by approving the alleyway
vacation.
The City Plan Commission voted 7-0 to recommend approval of thi petition at the June 7, 2007
hearing; the minutes of the meeting are attached.
BACKGROUND: A title search was conducted earlier this year and re earch found that this alleyway
located in the 400 Block of South Franklin Street was never formally acated. This petition request
from the Economic and Urban Development Department is to formally acate the 20 foot by 240 foot
alleyway to create a clear title search in the future. The City had allo ed construction on and across
this alleyway in the past. The alleyway would continue to be used as i has been utilized for the past
several years.
The entire West 165 feet of alleyway will continue to be the responsibili y of the property owner to the
North and the entire East 75 feet of the alleyway will continue to be th responsibility of the property
owner to the North and South. Both owners have been paying taxes a d been responsible for the 20
foot alleyway for many years.
All utilities have been notified. The abutting property owners hav been notified and have no
objections to the proposed alleyway vacation.
POTENTIAL OBJECTION: There were no known objectors at the Pl n Commission meeting.
STAFF REFERENCE: Any additional questions may be forwarded t Suzan Stickle at 424-2786 or
at smstickle(adecaturnet.org.
BUDGET/TIME IMPLICATIONS: None
