A title search was conducted earlier this year and research found t at this alleyway was never <br /> formally vacated. This petition request from the Economic and Urba Development Department <br /> is to formally vacate the 20 foot by 240 foot alleyway to create a cle r title search in the future. <br /> The City had allowed construction on and across this alleyway in the ast. <br /> PROJECT DESCRIPTION <br /> 2. The Economic and Urban Development Department is requestin the formal vacation of the <br /> 20 by 240 foot alleyway. The alleyway would continue to be used a it has been utilized for the <br /> past several years. The alleyway currently has a building constru ted over it where Tommy <br /> House Tires is located. Also, there are parking stalls and a driveway n the 20 foot alleyway. <br /> STAFF ANALYSIS <br /> 1. All utilities have been notified. The abutting property owners hav been notified and have no <br /> objections to the proposed alleyway vacation. <br /> 2. The entire West 165 feet of alleyway will continue to be the re onsibility of the property <br /> owner to the North and the entire East 75 feet of the alleywa will continue to be the <br /> responsibility of the property owner to the North and South. Both owners have been paying <br /> taxes and been responsible for the 20 foot alleyway for many years. <br /> 3. The formal vacation of this alleyway will not have an adverse affe t on the general public. <br />
