the City enter into such an agreement. !n such an agreement, the City may provide for <br /> terms and conditions inconsistent with this Chapter. <br /> D. Effect of Franchises, Licenses, or Similar Agreements. <br /> (a) Utilities Other Than Telecommunications Providers. In the event that <br /> a utility other than a telecommunications provider has a franchise, license <br /> or similar agreement with the City, such franchise, license or similar <br /> agreement shall govern and control the installation, operations and <br /> maintenance of infrastructure as s.trictly described in such franchise <br /> agreement, during the term of such agreement and any lawful renewal or <br /> extension thereof. Installation, operation and maintenance of <br /> infrastructure resulting from changed technology not in common usage or <br /> reasonably contemplated for use as of the franchise agreement date shall <br /> be governed by the requirements of this ordinance. <br /> (b) Telecommunications Providers. In the event of any conflict with, or <br /> inconsistency between, the provisions of this Chapter and the provisions <br /> of any franchise, license or similar agreement between the City and any <br /> telecommunications provider, the provisions of such franchise, license or <br /> similar agreement shall govern and control the installation, operations and <br /> maintenance of telecommunications infrastructure as strictly described in <br /> such franchise agreement, during the term of such agreement and any <br /> lawful renewal or extension thereof.
