In the event State o Federal law allows for <br /> other service providers of a similar type and use s a utility or <br /> telecommunication provider, the same rules shall apply. Installation, <br /> operation and maintenance of infrastructure resul ing from changed <br /> technology not in common usage or reasonably c ntemplated for use as <br /> of the date of this ordinance shall be governed b the requirements of this <br /> ordinance <br /> E. Conflicts with Other Chapters. This Chapter supers des all Chapters or parts <br /> of Chapters adopted prior hereto that are in conflict herewith, t the extent of such <br /> conflict. <br /> F. Conflicts with State and Federal Laws. In the event hat applicable Federal or <br /> State laws or regulations conflict with the requirements of this hapter, the utility shall <br /> comply with the requirements of this Chapter to the maximum xtent possible without <br /> violating Federal or State laws or regulations. <br /> G. Sound Engineering Judgment. The City shall use s und engineering <br /> judgrrient when administering this Chapter and may vary the s andards, conditions, and <br /> requirements expressed in this Chapter when the City so dete mines. Nothing herein <br /> shall be construed to limit the ability of the City to regulate its r ghts-of-way for the <br /> protection of the public health, safety and welfare. <br /> 3 <br />
