Excerpts from Plan Commission Minutes of Apri15, 2007 <br /> Cal. No. 07-12 Petition of Frank H. BYER II to rezone 144 and <br /> 154 East Johnson Street a d 1805 North Water <br /> Street from R-6 Multipl Dwelling and B-2 <br /> Commercial Districts to O-1 Office District. <br /> Mrs. Stewart was sworn in by Mrs. Althoff. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site is located at 144 and 154 East Johnson Street nd 1805 North Water <br /> Street and contains approximately 0.66 acres (29,000 square fee ). Two of the lots are <br /> vacant and the third has a single family residence on the property. <br /> The petitioner proposes to rezone the three lots from R-6, Multipl Dwelling District and <br /> B-2, Commercial District to O-1, Office District in order to b ild an office building <br /> which will house a law office. <br /> The surrounding zoning includes R-6, Multiple Dwelling Distric and B-2, Commercial <br /> District. Property to the east and across Water Street is zoned M- , Intense Commercial- <br /> Light Industrial District. The Decatur Urban Area Land Use Pl n shows this area as a <br /> mixed use area which includes Office, Commercial, and Commercial Planned <br /> Development. The proposed use is compatible with adjacent es in the surrounding <br /> area. The rezoning should not have an adverse affect of the surro ding area. <br /> The rezoning and proposed use is consistent with the intent of t e Comprehensive Plan <br /> and the Decatur Urban Corridors Plan. A site plan will e required for future <br /> development. <br /> Staff recommends approval of the rezoning. <br /> Mr. Frank Byers, petitioner, was sworn in by Mrs. Althoff. <br /> Mr. Byers stated that he would like to build an office building. <br /> There were no questions asked to either the petitioner or to staff. <br /> There were no objectors present. <br /> It was moved and seconded (John/Mickler) to forward Calendar No. 07-12 to the City <br /> Council with recommendation for approval as submitted. Motion arried unanimously. <br />
