Mr. Livingston asked whether the petitioner was in compliance ow but was not in the <br /> past but over time the petitioner did come into compliance. <br /> Mr. Crowe stated that they were in compliance with the original P D and amended PUD <br /> for the parking requirements per the zoning ordinance. Mr. Crowe stated that the <br /> problem was that they did not have enough parking for the usag of the site for the last <br /> amendment and had to get more parking. <br /> Mr. Cochran stated that 21 property owners located near the proposed addition signed a <br /> petitioner in support of the proposed addition. Mr. Cochran stated that he has been <br /> involved with the project since 1994 when Bob Penwell own d the property. The <br /> petition was approved in 1994 with significant opposition of the eighborhood. Mr. Bob <br /> Penwell did not complete the site as approved by not completi g the landscaping and <br /> berm. Mr. Cochran stated that in 2001, Brian Penwell purchased t e property and wanted ', <br /> to change the parking. The parking did not function well. Garba e was difficult to pick ' <br /> up and there was no turnaround. Mr. Cochran stated that the a jacent owners did not ' <br /> object to the new parking. Mr. Penwell currently has three e ployees and with the ' <br /> proposed addition, he will add two more employees. Mr. Cochr stated that if parking !, <br /> becomes a problem where the petitioner would have to add ditional parking, Mr. j <br /> Penwell will find a new location. '', <br /> There were no objectors present. II <br /> It was moved and seconded (Nordholm/Livingston) to forward Ca endar No. 07-15 to the <br /> City Council with recommendation for approval.
