The petitioner is requesting vacating public right-of-way in the 2 00 Block of East Millikin <br /> Parkway. The vacation will enable the petitioner to fence in its entire site. <br /> STAFF ANALYSIS <br /> 1. The petitioner does not currently own all of the property adjacent t the right-of-way but have <br /> notified the abutting property owner. They have no interest in the outh 30 feet of the 60 foot <br /> right-of-way vacation. <br /> 2. Letters were sent to AmerenIP, Insight Communications and T&T notifying the utility <br /> companies of the vacation request. An easement will be reserved for tility access. <br /> 3. An appraisal was submitted by the petitioner with an estimated m ket value of$3,500.00. A <br /> second appraisal was obtained by the City with an estimated mark t value of $2,800.00. The <br /> petitioner will pay the City of Decatur$3,500.00 for the vacated right of-way. <br /> STAFF RECOMMENDATION <br /> 4. Staff is of the opinion that the best interests of the City of De atur would be served by <br /> approving the request to vacate the street right-of-way. Staff rec mmends approval of the <br /> petition. <br /> PLAN COMMISSION ACTION <br /> 5. The Administrative Policy of the City of Decatur requires that pr perty vacation requests be <br /> submitted for a public hearing. Although a Plan Commission recom endation is not required, a <br /> motion to forward the request of Cal. No. 07-OS to the City Council ith a recommendation for <br /> approval is suggested. <br />
