Cr , Director of Economic and Urban Developmen� Suzan Stick , Senior Planner 3y � SUBJECT: Request to vacate the 100 Block of South Union Street SUMMARY RECOMMENDATION: Staff recommends approval of he right-of-way vacation petition. The public right-of-way does not appear necessary to serve the general ublic. Staff is of the opinion that the best interests of the City of Decatur would be served by appro ing the right-of-way vacation request. The City Plan Commission voted 7-0 to recommend approval of this etition at the March 1, 2007 hearing; the minutes of the meeting are attached. BACKGROUND: The subject petition requests the right-of-way vaca ion of the 100 block of South Union Street to allow for additional parking in their proposed Planned D velopment. The petitioner owns the property abutting the right-of-way to the east. St. Paul's Lutheran Church owns the property abutting the right-of-way to the west. The southern pqrtion of the right-of-way to be vacated abuts the alley and the northern portion abuts the West Main StrQet right-of-way. An appraisal for the street vacation was submitted by the petitioner with n estimated market value of $2,250. A second appraisal was obtained by the City with an estimated arket value of$4,100. The petitioner will pay the City of Decatur $4,100 for the vacation. All utilities have been notified and have no objections to the vacation r quest. Utility easements will not be required. The abutting property owner has been notified and has no objections to the proposed right-of-way vacation. POTENTIAL OBJECTION: There were no known objectors at the Pl n Commission meeting.
