Cr , Director of Economic and Urban Developmen� <br /> Suzan Stick , Senior Planner 3y � <br /> SUBJECT: Request to vacate the 100 Block of South Union Street <br /> SUMMARY RECOMMENDATION: Staff recommends approval of he right-of-way vacation <br /> petition. <br /> The public right-of-way does not appear necessary to serve the general ublic. Staff is of the opinion <br /> that the best interests of the City of Decatur would be served by appro ing the right-of-way vacation <br /> request. <br /> The City Plan Commission voted 7-0 to recommend approval of this etition at the March 1, 2007 <br /> hearing; the minutes of the meeting are attached. <br /> BACKGROUND: The subject petition requests the right-of-way vaca ion of the 100 block of South <br /> Union Street to allow for additional parking in their proposed Planned D velopment. <br /> The petitioner owns the property abutting the right-of-way to the east. St. Paul's Lutheran Church <br /> owns the property abutting the right-of-way to the west. The southern pqrtion of the right-of-way to be <br /> vacated abuts the alley and the northern portion abuts the West Main StrQet right-of-way. <br /> An appraisal for the street vacation was submitted by the petitioner with n estimated market value of <br /> $2,250. A second appraisal was obtained by the City with an estimated arket value of$4,100. The <br /> petitioner will pay the City of Decatur $4,100 for the vacation. <br /> All utilities have been notified and have no objections to the vacation r quest. Utility easements will <br /> not be required. The abutting property owner has been notified and has no objections to the proposed <br /> right-of-way vacation. <br /> POTENTIAL OBJECTION: There were no known objectors at the Pl n Commission meeting. <br /> STAFF REFERENCE: Any additional questions may be forwarded t Suzan Stickle at 424-2786 or <br /> at smstickle(a�decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: None <br />
