No. 06-57 Petition of DAVID AND NI A PHILLIPS; <br /> EASTER JOHNSON; AND VIN BENNETT <br />, to rezone premises commoni known as 2143, <br /> 2151, and 2159 East Wood S reet from B-2 <br /> Commercial District to R-3 S'ngle Family <br /> Residence District. <br />, Mr. Mark Smith was sworn in by Ms. Jesse. <br /> Mr. Mark Smith presented the recommendation of staff: <br />' The subject petition requests that the properties in question be rez ned from B-2 <br />' Commercial District to the R-3 Single Family Residential District. There are three (3) <br /> properties at issue and three petitions were filed. They have since een combined into <br /> one petition. Each tract is improved with a single family residenc . The lots are <br /> approximately 5,000 square feet and measure 122.5 feet long by 3 to 42 feet wide. The <br /> tracts are owned by three different individuals. <br /> Each of the three lots are currently improved with a house and use as residences. The <br /> residences are zoned B-2 Commercial District and are therefore n n-conforming. The <br /> petitioners have requested the residential zoning so that the reside ces could be rebuild in <br /> the event they were destroyed,home improvements could be fin ced and that mortgages <br /> might be written in the event of refinancing or sale. <br /> The properties in question lie west of and adjacent to a gas station on the southwest I <br /> corner of East Wood Street and North 22nd Street and generally est of the B-2 <br /> Commercial District which surrounds that same intersection. T e area north, west and <br /> south contained improved small lots with single family residence . There is no � <br /> information in the files that would indicate the reason the subject esidences are zoned <br /> commercial. The R-3 Single Family Residence zoning requested 's consistent with <br /> nearby properties on three sides. i <br /> Based on the above analysis, staff recommends approval of the re oning from B-2 II <br /> Commercial District to R-3 Single Family Residence District. I, <br /> The Plan Commission, in its advisory role to the City Council, m y make a ' <br /> recommendation to approve the request to rezone the property fro B-2 Commercial <br /> District to R-3 Single Family Residence District or to recommend to the City Council that <br /> the petition be denied. ', <br /> Section XXIX, G, requires the Plan Commission to hold a public earing on a rezoning <br /> request and then forward its report and recommendation to the Ci y Council for final <br />
