STAFF REPORT , <br /> Decatur City Plan Commission <br /> COMMON NAME: Mound Center <br /> GENERAL INFORMATION <br /> Hearing Date July 6, 2006 <br /> Calendar No. 06-40 <br /> Property Location Mound Center-Mound Road and US Business 51 <br /> Requested Action Partial vacation of utility easement <br /> Petitioner Dane Bragg, Assistant City Manager <br /> LAND USE AND ZONING <br /> Direction Existing Land Use Zoning Comprehensive Plan <br /> Subject Property Retail B-3 Commercial, Planned <br /> Development <br /> North Single-Family Residential R-3 Low Density Residential <br /> South Single-Family Residential R-1,R-3 Low Density Residential <br /> East Single-Family Residential R-1, R-2 Low Density Residential <br /> West Single-Family Residential R-1 Low Density Residential <br /> BACKGROUND <br /> 1. As part of the Mound Center subdivision, a watermain and utility easement was dedicated on <br /> the south property line of Lot Four(4). AT&T is utilizing the easement for its cable; no other <br /> utility companies have located any utilities in the easement. <br /> 2. The watermain for the site has been relocated and a new easement has been dedicated. <br /> STAFF ANALYSIS <br /> 1. The partial vacation will restrict the use of the easement to AT&T. Further use of the <br /> easement by another utility company will not be allowed. <br /> 2. Since AT&T is utilizing the easement, construction of permanent buildings will not be <br /> allowed in the easement. <br /> STAFF RECOMMENDATION <br /> 1. Staff is of the opinion that the best interests of the City of Decatur would be served by <br /> approving the request to partially vacate the easement as indicated on the plat. Staff <br /> recommends approval of the petition. <br />
