Excerpts of Decatur City Plan Commission, June 1, 2006 <br /> Cal. No. 06-34 Petition of GARY JASPER, to rezone the premises <br /> located at 1726 West Rock Springs Road from R-1 <br /> Single Family Residence District to B-2 Commercial <br /> District. <br /> Mr. Mark Smith was sworn in by Ms. Jesse. <br /> Mr. Smith presented the recommendation of staff: <br /> The subject petition requests that the property be rezoned from R-1 Single Family <br /> Residential District to B-2 Commercial District. The property at issue in this case is part <br /> of a larger tract,both owned by the same owner. Approximately one-half of the tract will <br /> be annexed in the city limits as R-1 Single Family Residence District and the other half <br /> (currently within the corporate limits) is zoned B-2 Commercial District. The petitioner <br /> has requested that the part of the property to be annexed to the City be rezoned to the B-2 <br /> Commercial District. The property in question contains approximately 9,571 square feet. <br /> The property is currently used as a tavern (on that portion already in the City). The <br /> property to be rezoned B-2 is currently used as parking for Mel's Beer Shed. The <br /> petitioner wishes to demolish the existing building and build a new tavern. <br /> Generally, on three of the sides adjacent to the property in question, the nearby land is <br /> zoned M-1 Light Manufacturing by Macon County. The tract immediately west of the <br /> property in question is currently zoned R-1 Single Family Residential by the City, but it <br /> is used as a nonconforming parking lot for the tavern customers. The properties <br /> generally to the south and across Rock Springs Road are zoned R-1 Single Family <br /> Residence District. <br /> The tavern has existed for many decades. There are many commercial and light <br /> industrial uses in the immediate vicinity, to the east, west, northwest and north. The <br /> Decatur Area Urban Land Use Map shows the area as Commercial. <br /> Based on the above analysis, staff recommends approval of the rezoning from R-1 Single <br /> Family Residence District to B-2 Commercial District. <br /> The Plan Commission, in its advisory role to the City Council, may make a <br /> recommendation to approve the request to rezone the property from R-1 to B-2 <br /> Commercial or to recommend to the City Council that the petition be denied. <br /> Section XXII.A.2. requires the Plan Commission to hold a public hearing on a rezoning <br /> request and then forward its report and recommendation to the City Council for final <br /> approval. A motion to forward Calendar Number 06-22 to the City Council with a <br /> recommendation for approval is suggested <br />
