, ,
ECONOMIC AND URBAN DEVELOPMENT MEMORANDUM
Memo No. 06-96
May 10, 2006
TO: Honorable Mayor Paul Osborne and City Council Members
FROM: Steve Garma ity Manager
Dane C. Bra , AICP, Assistant City Manager
Kathy J. Miller, AICP, Senior Planner `„
SUBJECT: Sale of Land Adjacent to 134-136 South Main Street
SUMMARY RECOMMENDATION: Staff recommends approval of the sale of the four(4) foot
by sixty-five (65) foot strip of land adjacent to 136 South Main Street.
BACKGROUND: It was recently discovered that the property located at 134-136 South Main
Street encroaches onto the property owned by the City of Decatur. Currently the building's
parking lot and retaining wall is located four feet on the city's property. The owner wishes to
cure the encroachment by purchasing the four (4) foot by sixty-five (65) foot strip of land. This
sale was not advertised according to City Council Policy as the property is landlocked and has no
value but to the city or to the adjoining property owner. The sale will correct a long-standing
encroachment and return the property to taxable status.
POTENTIAL OBJECTIONS: There are no known objectors to the sale of the land.
INPUT FROM OTHER SOURCES: Economic and Urban Development, Engineering and
Infrastructure, Fire and Water have reviewed the proposal and have no objections to the sale of
the land.
STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at
424-2786 or at kjmiller@decaturnet.org.
BUDGET/TIME IMPLICATIONS: An appraisal for the area to be sold was submitted with an
estimated market value of$1200. The Faries Wire Trust will pay the City$1200 for the property
to be sold.
