Excerpts from Decatur City Plan Commission, Apri16, 2006 <br /> Cal.No. 06-22 Petition of ROBIN FRAZIER for a Conditional � <br /> Use Permit at 715 West Division Street for a day <br /> care home, large. <br /> Mrs. Joselyn Stewart was sworn in by Ms. Jesse. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject petition requests a conditional use permit to allow the operation of a licensed <br /> large home daycare facility. The daycare would accommodate a maximum of eight (8) <br /> children with one care giver working alone; with an assistant 12-16 children could be <br /> cared for at the site. The area in question is presently zoned R-3, Single Family <br /> Residence District and is developed with a 1,064 square foot single family dwelling <br /> structure on a 5,920 square foot lot. <br /> The petitioner's drop off and pick up area will include her driveway and the area in front <br /> of her house along West Division Street. The petitioner shall request a drop off area from <br /> the Parking and Traff'ic Commission. Currently the rear yard is partially faiced; the <br /> petitioner will be required to fence the entire rear yard with a secured entrance. <br /> Section XXII.A3. lists three standards which must be met in order to grant a conditional <br /> use permit. The first standard requires the applicant to show that the use is "necessary for <br /> the public convenience at the location." The proposed use is generally compatible with <br /> the neighborhood and provides a service which can be utilized by area residents. <br /> The proposed use also meets the second standard. The facility is located and designed to <br /> be operated in a manner that the public health, safety and welfare will be protected. <br /> This use also meets the third standard, the facility will not cause substantial injury to the <br /> value of other properties in the neighborhood. The day caze use will be required to meet <br /> all applicable City of Decatur building and fire codes, as well as all requirements <br /> imposed by the State of Illinois in the issuance of a home day care license. <br /> Based on the above analysis, staff recommends approval of the petition as submitted with <br /> the following conditions: a dro�roff/pick-up area will be required along West Division; <br /> the proposed operation be in compliance with applicable provisions of the City's adopted <br /> building codes, including obtaining a building permit to perform any proposed or <br /> required improvements to the existing dwelling;that the proposed daycare be at all times <br /> appropriately licensed by the State of Illinois and a copy of that license, upon approval, <br /> will be filed with the Economic and Urban Development Department;the State Fire <br /> Marshall shall be contacted regarding a field inspection and a copy of the fire inspection <br /> report, upon completion, will be filed with the Fire Department;a vented hood system <br /> will be required for cooking facilities; and a fence will be required with a secured <br /> entrance. <br />
