The subject petition requests a conditional use permit to allow the operation of a licensed large home <br /> daycare facility. The daycare would accommodate a maximum of eight (8) children with one care giver <br />' working alone; with an assistant 12-16 children could be cared for at the site. The area in question is <br /> presently zoned R-3, Single Family Residence District and is developed with a 1,064 square foot single <br /> family dwelling structure on a 5,920 square foot lot. <br /> PROJECT DESCRIPTION <br /> 2. The petitioner's drop off and pick up area will include her driveway and the area in front of her house <br /> along West Division Street. The petitioner shall request a drop off area from the Parking and Traffic <br /> Commission. Cunently the rear yard is partially fenced; the petitioner will be required to fence the entire <br /> rear yard with a secured entrance. <br /> STAFF ANALYSIS <br /> 3. The surrounding zoning includes R-3 Single Family Residence District. The Decatur Urban Area Land <br /> Use Plan shows this area as Low Density Residential. The proposed daycare is compatible with the <br /> adjacent single-family residence uses in the area. Adjacent property values will not be diminished with <br /> the operation of a daycare. <br /> 4. Section XXII.A.3. lists three standards which must be met in order to grant a conditional use permit. The <br /> first standard requires the applicant to show that the use is "necessary for the public convenience at the <br />
