The proposed use is generally compatible with the neighborhood and provides a service which <br /> can be utilized by area residents. <br /> 5. The proposed use also meets the second standard. The facility is located and designed to be operated in a <br /> manner that the public health, safety and welfare will be protected. <br /> 6. This use also meets the third standard, the facility will not cause substantial injury to the value of other <br /> properties in the neighborhood. The day care use will be required to meet all applicable City of Decatur <br /> building and fire codes, as well as all requirements imposed by the State of Illinois in the issuance of a <br /> home day care license. � <br /> STAFF RECOMMENDATI�N <br /> 1. Based on tk�e above analysis;staff recommends approval of the petition as submitted with the following ', <br /> conditions: ' <br /> a. A drop-off/pick-up area will be required along West Division; <br /> � b. The proposed operation be in compliance with applicable provisions of the City's adopted building <br /> codes, including obtaining a building permit to perform any proposed or required improvements to the <br /> existing dwelling; <br /> c. That the proposed daycare be at all times appropriately licensed by the State of Illinois and a copy of <br /> that license, upon approval, will be filed with the Economic and Urban Development Department; <br /> d. The State Fire Marshall shall be contacted regarding a field inspection and a copy of the fire <br /> inspection report, upon completion, will be filed with the Fire Department; <br /> e. A vented hood system will be required for cooking facilities; and <br /> f. A fence will be required with a secured entrance. <br /> PLAN COMMISSION ACTION <br /> 2. The Plan Commission in its advisory role to the City Council is to make recommendation to approve, <br /> modify or deny petitions based on the requirements of the Zoning Ordinance and the Comprehensive Plan. <br /> In conditional use/rezoning petitions, effects of the approved land uses for the proposed zoning district on <br /> the public health safety and general welfare of the City and its citizens need to be considered. <br /> 3. Section XXII.A.2. requires the Plan Commission to hold a public hearing on a rezoning request, and then <br /> forward its report and recommendation to the City Council for final approval. A motion to forward <br /> Calendar Number 06-22 to the City Council with a recommendation for approval is suggested. <br /> The above report constitutes the testimony and recommendation of the Planning and Economic Development <br /> Division, Economic and Urban Development Department, City of Decatur. <br /> Joselyn A.
