� <br /> .� '• , , � Bo o k : 3923 Pag e : 953 <br /> � AMENDMENT TO REDEVELOPMENT AGREEMENT <br /> THIS AMENDEMENT TO REDEVELOPMENT AGREEMENT <br /> (this "Amendment") is entered into this � day of August, 2008, by <br /> and between REYNOLDS DEVELOPMENT, LLC, a limited liability <br /> company (the "Developer") and the CITY OF DECATUR, an Illinois <br /> home rule municipal corporation (the "Municipality"). <br /> RECITALS <br /> A. Developer and Municipality entered that certain Redevelopment <br /> Agreement dated November 7, 2006 (the "Agreement"), for the purchase of <br /> the Premises located within the Development Area as described in Exhibit A <br /> to the Agreement in order to undertake a certain Development Project. <br /> B. Unless otherwise defined in this Amendment, capitalized terms <br /> shall have the meanings assigned to them in the Agreement. <br /> C. Developer and Municipality desire to amend paragraph 8.3 of <br /> the Agreement to change Municipality's deadline for demolition or <br /> redevelopment of the dilapidated buildings across North Water Street with <br /> street addresses 301 through 363, both inclusive, North Water Street (as <br /> legally described on Exhibit C to the Agreement) from July 25, 2008 to June <br /> 23, 2008Developer and Municipality further desire to amend paragraph 8.3 <br /> of the Agreement to change the deadline by which Municipality must <br /> complete its conversion of those properties with street addresses 327 through <br /> 335 North Water Street to a permanent pedestrian courtyard from July 25, <br /> 2008 to December 15, 2008. <br /> D. Developer and Municipality further desire to amend Exhibit C 1 <br /> to the Agreement from that which is currently attached as Exhibit C 1 to the <br /> Agreement to that which is attached as Exhibit C 1 attached to this <br /> Amendment. <br /> E. Developer and Municipality further desire to amend paragraph <br /> 8.4 of the Agreement to provide that Municipality shall lease at least 140 <br /> parking spaces on the second floor in Municipality's parking deck located at <br /> the intersection of North Water Street and North Street at no charge, for the <br /> initial lease term, to employees, representatives, and tenants of Developer, <br /> 1 <br />
