7. The making of payment for the work shall constitute a waiver of all claims made by <br /> CITY, other than those arising from unsettled claims of third parties or agents of EIU, or from <br /> faulty or defective work appearing after such payment. <br /> 8. The acceptance of payment for work performed hereunder shall constitute a waiver of all <br /> claims made by EIU, which occurred prior to the acceptance of said payment. <br /> 9. All persons performing wark under this contract shall be considered employees or agents <br /> of EIU, which shall be solely responsible for their employment, equipment, training, and <br /> supervision. <br /> 10. EIU shall provide CITY proof of workers compensation insurance according to the <br /> provisions of the Illinois Workers' Compensation Act, as amended. <br /> Employers Liability <br /> a. Each Accident $500,000 <br /> b. Disease - policy limit $500,000 <br /> c. Disease - each employee $500,000 <br /> 11. EIU shall provide CITY proof of commercial general liability insurance, subject to the <br /> following minimum limits: <br /> General Aggregate Limit $2,000,000 <br /> Products-Completed Operations Aggregate Limit $2,000,000 <br /> Each Occurrence Limit $1,000,000 <br /> Insurance shall be written in the occurrence form and shall provide coverage for operations of <br /> EIU, its employees, agents and/or subcontractors. The coverage shall provide by endorsement <br /> that the City of Decatur, its officers, and employees shall be named as additional insureds with <br /> respect to the policies, and any excess liability coverage for occurrences arising in whole or in <br /> part out of the work and operations performed. EIU's insurance shall be primary. <br /> 12. EN shall provide CITY proof of State of Illinois Self-Insured Motor Vehicle Liability <br /> Plan subject to the following minimum limit: <br /> Bodily Injury & Property Damage Limit Each Occurrence $1,000,000 <br /> The policy shall cover owned, and hired vehicles. EIU personnel shall neither operate nor be <br /> present in City motor vehicles, and City personnel shall neither operate nor be present in EIU <br /> motor vehicles. <br /> Page 2 of 4 <br />
