� t <br /> 21.MRI, and its employees, particularly those in supervisory capabilities, shall <br /> keep their safety, the safety of the employees under their direction, and the <br /> safety of the public using appurtenant streets and sidewalks constantly in mind <br /> in the performance of the work under this AGREEMENT. <br /> 22.MRI and its agents and employees shall refrain from interfering with automobile <br /> or pedestrian traffic on sidewalks and streets adjacent to work sites. All work <br /> described herein shall be perFormed without disrupting regular vehicular traffic. <br /> In the event MRI reasonably believes work cannot be performed at a site <br /> without temporarily disrupting traffic flow, it shall immediately notify the CITY in <br /> writing. Thereafter, the terms of this AGREEMENT shall be modified to remove <br /> the site from the 2008 SERVICE SCHEDULE, with appropriate reduction in <br /> staffing levels, and payments required hereunder. Under no circumstances <br /> shall MRI shall perForm work in interference with automobile traffic. <br /> 23.MRI shall be responsible for the faithful performance of this AGREEMENT, and <br /> shall have such internal monitoring procedures and processes in place as shall <br /> ensure compliance. <br /> 24.CITY reserves the right to monitor and track MRI's performance over the <br /> course of the AGREEMENT, and may use information so gathered when <br /> evaluating MRI's perFormance of the AGREEMENT requirements. <br /> 25.MRI shall cooperate with CITY in monitoring and tracking MRI's perFormance <br /> hereunder, which may require that MRI report progress and problems (with <br /> proposed resolutions), provide records of its performance, allow random <br /> inspections of its work and safety precautions at job sites, participate in <br /> scheduled meetings, and provide management reports as requested by CITY. <br /> 26.MRI and its officers, agents and employees shall not: <br /> a) Commit any unfair employment practices as defined in the Department <br /> of Human Rights Regulations; <br /> b) Be deemed employees of the CITY; <br /> c) Represent themselves as employees of the CITY; <br /> d) Employ any illegal alien; <br /> e) Possess any firearm, illegal drug or alcoholic beverage during work <br /> hours or on CITY property. <br /> 27.MRI shall provide and employ sufficient labor and equipment to ensure that <br /> services enumerated herein shall be performed to full completion in the manner <br /> and time required herein, and further shall provide personnel with sufficient <br /> skills and experience to properly perform the work assigned to them <br /> 28.MRI shall provide all supplies, materials, equipment, labor and supervision to <br /> satisfy the requirements of this AGREEMENT. <br /> 29.MRI shall observe all rules and regulations in effect and shall comply with all <br /> reasonable instructions issued by CITY. <br /> 4 <br />
