, , . , <br /> including cannabis, is prohibited in the COMPANY's workplace; specifying the actions that <br /> will be taken against employees for violations of such prohibition; and notifying the <br /> employee that, as a condition of employment on such contract, the employee shall abide by <br /> the terms of the statement, and notify the employer of any criminal drug statute conviction <br /> for a violation occurring in the workplace no later than five (5) days after such conviction; (b) <br /> Establishing a drug free awareness program to inform employees about the dangers of drug <br /> abuse in the workplace; the COMPANY's policy of maintaining a drug free workplace; any <br /> available drug counseling, rehabilitation, and employee assistance programs; and the <br /> penalties that may be imposed upon employees for drug violations; (c) Providing a copy of <br /> the statement required by subparagraph (a) to each employee engaged in the performance <br /> of the contract and to post the statement in a prominent place in the workplace; (d) Notifying <br /> the Department within ten (10) days after receiving notice from an employee or otherwise <br /> receiving actual notice of the conviction of an employee for a violation of any criminal drug <br /> statute occurring in the workplace; (e) Imposing or requiring, within thirty (30) days after <br /> receiving such notice from an employee of a conviction or actual notice of such a conviction, <br /> an appropriate personnel action, up to and including termination, or the satisfactory <br /> participation in a drug abuse assistance program approved by a federal, state, or local <br /> health, law enforcement, or other appropriate agency; (fl Assisting employees in selecting a <br /> course of action in the event drug counseling, treatment, and rehabilitation is required and <br /> indicating that a trained referral team is in place; (g) Making a good faith effort to continue <br /> to maintain a drug free workplace through implementation of the actions and efforts stated in <br /> this certification. <br /> Delinquent Payment. The COMPANY certifies that it, or any affiliate, is not barred from <br /> being awarded a contract under 30 ILCS 500. Section 50-11 prohibits a person from <br /> entering into a contract with a State agency if it knows or should know that it, or any affiliate, <br /> is delinquent in the payment of any debt to the State as defined by the Debt Collection <br /> Board. Section 50-12 prohibits a person from entering into a contract with a State agency if <br /> it, or any affiliate, has failed to collect and remit Illinois Use tax on all sales of tangible <br /> property into the State of Illinois in accordance with the provisions of the Illinois Use Tax Act. <br /> The COMPANY further acknowledges that the contracting State agency may declare the <br /> contract void if this certification is false or if the COMPANY, or any affiliate, is determined to <br /> be delinquent in the payment of any debt to the State during the term of the contract. <br /> Felony Convictions. The COMPANY certifies in accordance with 30 ILCS 500/50-10.5 that <br /> no officer, director, partner or other managerial agent of the contracting business has been <br /> convicted of a felony under the Sarbanes-Oxley Act of 2002 or of a Class 3 or Class 2 felony <br /> under the Illinois Security Law of 1953 for a period of five years prior to the date of the <br /> AGREEMEN�. The COMPANY acknowledges that the DEPARTMENT shall declare the <br /> contract void if this certification is false. <br /> Environmental Protection Act. The COMPANY certifies in accordance with 30 ILCS <br /> 500/50-12 that the COMPANY is not barred from being awarded a contract under this <br /> Section. The COMPANY acknowledges that the DEPARTMENT may declare the contract <br /> void if this certification is false. <br /> 3 <br />
