R2008-14 AUTHORIZING GRANT OF LICENSE WITH MILLIKIN UNIVERSITY

-2 - WHEREAS, the Project, as presently designed, will require the use of land owned by the University; and WHEREAS, the University agrees with the design concepts presented by the City and supports their construction; and WHEREAS, the University is willing to grant a license for the use of its land which is necessary for the Project; NOW, THEREFORE, the parties hereto agree as follows: 1. For and in consideration of the terms and conditions hereinafter set forth, the University to the extent it has authority to give such permission and grant such right hereby agrees to permit the City, and grants to the City, its successors and assigns (assignment requires the written consent of the University which shall not be unreasonably withheld), for and during the term hereof, the right and license to construct, operate, maintain, repair, alter, inspect, and otherwise make available for public use, the portion of the Project which extends into and onto certain land owned by the University, which land is described as follows: Parcel °A" Beginning at a point that is common to the Easterly Right-of-Way line of Fairview Avenue (Illinois Route 48) and the Northerly Right-of-Way line of West Main Street, said point being shown as Station 25+00.40-Offset 48.28 feet right of the centerline of Fairview Avenue per Right-of-Way Plat recorded as part of a Warranty Deed in Book 1881 Page 654 in the Records of the Macon County Recorder's Office; thence Northerly along said Easterly Right-of-Way line 62.48 feet; thence Northerly along said Easterly Right-of-Way line 27.56 feet; thence Northerly along said Easterly Right-of-Way line 160.19 feet; thence Northerly along said Easterly Right-of-Way line 35.91 feet; thence Northerly along said Easterly Right- of-Way line 52.90 feet; thence Northerly along said Easte�ly Right-of-Way line 364.59 feet to a point, said point being on the North line of Lot E per Plat Recorded in Book 149 Page 283 of the Records of the Macon County Recorder's Office; thence Easterly along said North line 8.63 feet; thence Southerly 360.77 feet to a point 10.19 feet normal distance East of said Easterly Right-of-Way line; thence Southerly 293.77 feet to a point 3.76 feet normal
