This section sets forth requirements and procedures with respect to construction
contracts for rehabilitation financed through this program.
For rehabilitation loans, construction will be undertaken only through a written contract
between the contractor and the borrower.
B. Form of Contract
The construction contract shall consist of a single agreement signed by the contractor and
accepted by the borrower. It shall contain the proposal amount, all general conditions,
and a description of all rehabilitation work to be performed. The contract may be
changed as federal, state and local laws, regulations or policies require.
C. Specifications and Drawings
Specifications (based on the work write-up and illustrative sketches covering the specific
rehabilitation work for each property on which a rehabilitation loan will be made) shall
be prepared by the owner and/or architect. Drawings shall be prepared when its essential
to show the scope and detail of the work involved, to insure clarity for a fair bid and to
avoid misunderstandings with potential bidders. The specifications and drawings shall be
based on an inspection of the property and interviews with the applicant. The
specifications shall clearly establish the nature of the work to be done and the material
and/or equipment to be installed. Known acceptable brands shall be identified by
reference to manufacturer's or association specifications; provisions shall be made for
acceptance of equal substitutions. All specifications shall specifically prohibit the use of
lead based paint and encourage lead-safe work practices when possible.
D. Obtaining Contractors Bid Proposals - Rehabilitation Loans
Borrowers are responsible for obtaining at least two (2) bids for the proposed
rehabilitation work.
E. Labor Performed bv Owner in Rehabilitation Property
Depending upon the type of work and the skill of the borrower, the borrower may
complete some or all of the tasks required to rehabilitate his/her property. Self-
help is usually appropriate for the accomplishment of tasks of an unskilled nature
such as general cleanup; demolition of small buildings on a property; removal and
disposal of the debris; and for work that involves minimal use of costly materials
and equipment. If the borrower possesses such skills, the items in the proposal
which he/she agrees to perform should be determined in advance. Borrower must
complete items before contractor bids on job.
CONTRACTOR QUALIFICATION PROCEDURES AND CONTRACTING POLICY
Contractor Procedures
10
