upon the evidence previously submitted by Insight; provided, however, that the legal, <br /> technical and financial ability of Comcast, as opposed to Insight, will then be an issue. <br /> Comcast agrees that it will not seek to require further discovery, introduce new exhibits <br /> or witnesses, except with respect to its legal, technical and financial qualifications, nor <br /> modify the Franchise Renewal Proposal previously submitted by Insight. This agreement <br /> does not waive any right that Insight, the City or Comcast has under state or federal law. <br /> The parties and Comcast agree that delay of the Administrative Hearing will not violate <br /> any due process right or any other right of either party. The parties agree that the <br /> scheduled hearing on June 18, 2007, will not proceed. The parties further agree that the <br /> costs, if any, incurred by the Hearing Officer for the June 18�' hearing will be shared <br /> equally by the parties.
