INC.� <br /> E N G I N E E R S <br /> Insurance <br /> ENGINEER shall provide insurance coverage in accordance with the attached City <br /> requirements. A certificate of insurance will be provided to the OWNER prior to <br /> commencement of the project. <br /> Compensation <br /> OWNER shall compensate ENGINEER for the Scope of Services described herein on an <br /> hourly rate basis for a limiting fee of$55,000,which includes expenses. <br /> Payment <br /> OWNER shall make monthly payments to ENGINEER for Services performed in the <br /> preceding month based upon monthly statements. Nonpayment 30 days after the date of <br /> receipt of invoice may, at ENGINEER's option, result in assessment of a 1 percent per <br /> month carrying charge on the unpaid balance. <br /> Changes <br /> 1. OWNER may, at any time, make changes within the general scope of this <br /> Agreement in the Services to be performed. If such changes cause an increase or <br /> decrease in ENGINEER's cost of or time required for performance of any Services <br /> under this Agreement, an equitable adjustment shall be made, and this Agreement <br /> shall be modified in writing accordingly. <br /> 2. No services for which additional compensation will be charged by ENGINEER shall <br /> be furnished without the written authorization of OWNER. The fee shall not be <br /> exceeded without agreement by OWNER but may be adjusted for time delays, time <br /> extensions, amendments, or changes in the Scope of Services. <br /> Personnel <br /> 1. Brian L. Hackman shall be ENGINEER's Project Manager for the performance of <br /> the Services. If, for any reason, Mr. Hackman is unable to perform as Project <br /> Manager, OWNER has the right to interview and select a replacement Project <br /> Manager from ENGINEER's professional staff. <br /> 2. Rob Shirley, Water Production Manager, shall be OWNER's Project Manager. <br /> Schedule <br /> The schedule assumes that OWNER will sign this Agreement so that Services can start on <br /> August 6, 2007.
