shall indemnify and defend (including payment of City's attorney's fees and costs) City against <br /> any claims, suits, or actions for death or injury to persons, damage to property, breach of <br /> contract, or any other claim or demand brought against City arising out of or touching upon or in <br /> connection with these repairs, whether or not suit is filed. Dunn and/or its agent(s) shall obtain, <br /> and provide City proof of, adequate insurance coverage, including workers compensation and <br /> liability insurance, and shall name City as an additional insured. <br /> 9. The persons affixing their signatures to this agreement certify that they have full <br /> authority to bind their respective parties. <br /> 10. This Agreement shall be binding upon the parties' grantees, successors, and heirs. <br /> 1 l.
