3. Repairs shall be completed within 180 days of the date of this Agreement. Upon final <br /> inspection and approval of the repairs, and subject to the provisions of Section 7, below, City <br /> shall reimburse Dunn $21,750.00, as and for the reasonable value of the repairs. <br /> 4. Work encompassed by this Agreement shall be performed in accordance with <br /> applicable Federal, State, and City laws, regulations and ordinances. <br /> 5. The applicable prevailing wage for Macon County for the month(s) during which the i <br /> work is performed, as determined by the Illinois Department of Labor, shall be paid for work <br /> encompassed by this Agreement. <br /> 6. Work within the City right of way shall be performed only by contractors fully bonded <br /> and licensed by the City to work in City right of way. <br /> 7. As a condition of the City making payment under this Agreement, Dunn shall provide <br /> City the following documents: <br /> A. Certified copies of weekly payroll records of persons employed by Dunn, <br /> Contractor(s), and subcontractor(s), for work encompassed by this Agreement, <br /> including the name, address, and rate of pay for all employees performing work <br /> encompassed by this Agreement. <br /> B. Fully executed and binding lien waiver affidavit(s) from every entity performing <br /> work encompassed by this Agreement. The lien waivers shall set forth amounts due <br /> for labor, material(s) (including freight and demurrage charges), and charges for <br /> apparatus, fixtures, or machinery used in said repairs, and shall state unequivocally <br /> that said amounts have been satisfied. <br /> 8. Except for claims, suits, demands, or actions arising out of the intentional or negligent <br /> acts of City, Dunn, for itself and any entity performing work encompassed by this Agreement, <br />
