RETAINING WALL REPAIR AGREEMENT <br /> THIS AGREEMENT made this (� "' day of November, 2006,between the City of <br /> Decatur, Illinois, a municipal corporation ("City"), and Dunn Company("Dunn"), <br /> WITNESSETH: <br /> WHEREAS, the retaining wall on the west side of Monroe Street, north of the viaduct <br /> under the Norfolk Southern Railroad, ("retaining wall") is in need of repair, and; <br /> WHEREAS, said retaining wall is situated within City right of way, and; <br /> WHEREAS, Dunn agrees to repair the retaining wall for$21,725.00, and; <br /> WHEREAS, City agrees to pay Dunn $21,725.00, to repair the retaining wall. <br /> NOW, THEREFORE, City and Dunn agree as follows: <br /> 1. Dunn shall be responsible for the repair of the retaining wall, and shall let such <br /> contract(s) as it deems prudent, to accomplish the repairs. <br /> 2. The following repairs shall be completed: <br /> A. Remove loose mortar and tuck-point the brick facing of the retaining wall, and; <br /> B. Replace damaged or missing brick(s), and; <br /> C. Repair or replace damaged concrete cap stonework, and; <br /> D. Caulk cap joints, and; <br /> E. Wash brick and concrete cap, and; <br /> F. Remove existing fence atop the wall, and replace with an ornamental steel fence, <br /> and; <br /> G. Paint the new fence, paint color and quality subject to approval by City. <br />
