, ' COUNCIL COMMUNICATION FORM � Engineering & Infrastructure Memorandum NO. 2006-44 July 7, 2006 TO: Honorable Mayor Osborne and City Council FROM: Steve Garman, City Manager� Stephen Swanson, P.E.,Director of Engineering & Infrastructure�7�� SUBJECT: Deer Run Subdivision Sanitary Sewer Service Agreement SUMMARY RECOMMENDATION: It is recommended by City staff that the City Council approve the attached resolution authorizing a Sanitary Sewer Service Agreement between the City of Decatur and the property owner/ developer of the Deer Run Subdivision, authorize the City Manager and the Director of Engineering and Infrastructure to enter into the Sanitary Sewer Service Agreement and that the Mayor be authorized to sign said Resolution, and the City Clerk to attest. BACKGROUND: • The developer of the Deer Run Subdivision has requested that the City accept the ownership and maintenance responsibility of the public sanitary sewer system being constructed at the developer's expense to serve the subdivision. The subdivision is located on Turpin Road about one-half mile outside the City's Corporate Limits (refer to attached locale map). It is not typical for a subdivision outside the City limits to have access to a sewer main. In this case it happens that an interceptor sewer owned by the Sanitary District of Decatur that primarily serves Mt. Zion is accessible. The Sanitary District does not accept the ownership and maintenance responsibility of small diameter sewers but requires there to be an identified owner responsible for the sewer. Since this subdivision will be connecting to the City's water system the developer asked City staff if the City would accept the ownership of the new sewer as it will for the public water mains. This request was unprecedented to current staff's knowledge and staff responded that it would have to consider the request. Staff's review of the request determined that the relative additional cost to the City to maintain the new sewer system would be negligible for the first 5 to 10 years. The new sewer would be constructed to current standards and specifications and subj ect to inspection during its installation. In addition, the sewer would be televised and tested and any noted deficiencies corrected prior to the City accepting ownership of the sewer.
