� .! <br /> 2 <br /> oil ("Material") stored in the Tank. The SPCC plan will be certified by a <br /> Professional Engineer(P.E.). The SPCC plan will include a description of <br /> the operation and maintenance of the Storm Water Basin. ADM will <br /> provide a copy of the SPCC plan to City upon P.E. certification. <br /> 2. ADM shall comply with all local, state, and federal regulations regarding <br /> the use of the City Storm Water Basin as secondary containment for the <br /> Tank. ADM shall indemnify and hold City harmless for failure to do so. <br /> 3. As necessary, ADM shall design modifications to the Storm Water Basin <br /> located on City property to insure that in the event of release of Material to <br /> City property, the Material will be contained within the Storm Water <br /> Basin. ADM shall submit the design to City for approval. Upon City <br /> approval,ADM shall, at its sole risk and expense, construct modifications <br /> at City property. Any future modifications to the Storm Water Basin shall <br /> be submitted to the City for approval. Construction work on City property <br /> shall be performed by a contractor that is licensed and bonded to work on <br /> City property. City shall have the right to inspect and approve the <br /> completed improvements. <br /> 4. As specified in the facility SPCC plan, containment structures are <br /> inspected semi-annually. Therefore, any modification to City property <br /> that is part of the containment system for the facility will be inspected <br /> semi-annually. <br /> 5. As necessary,ADM shall design modifications to the Storm Water Ditch <br /> located on the West end of ADM North Plant Property to insure that in the <br />
