w . � i , <br /> After reviewing the matter staff determined that the use of the City's detention area by ADM in <br /> its SPCC plan was acceptable to the City. This decision was largely based on the fact that the <br /> use of the City's property was highly unlikely as there was sufficient secondary containment <br /> capacity existing on ADM's property. ADM was informed of staff's determination and asked to <br /> prepare an agreement for review and approval by City staff and subject to the approval of the <br /> City Council. <br /> A final agreement addressing the issues identified by City staff has been prepared and agreed to <br /> by ADM. A copy of the agreement is attached. Staff is recommending approval of the <br /> agreement. <br /> POTENTIAL OBJECTION: No known objectors. <br /> INPUT FROM OTHER SOURCES: <br /> Input on this matter was obtained from Peter Brinkoetter, ADM West Environmental Manager; <br /> Michelle Bublitz, ADM Divisional Environmental Manager; Matt Newell, City Engineer; <br /> Wendy Morthland, City Corporation Counsel and Barry Leonard, City Risk Manager. <br /> STAFF REFERENCE: <br /> The Director of Engineering and Infrastructure, Steve Swanson, will be in attendance at the City <br /> Council meeting to answer any questions of the Council on this item. , <br /> BUDGET/TIME IMPLICATIONS: II'I <br /> There are no adverse budgetary impacts associated with the approval of the agreement. <br /> Attach: 3 <br /> cc: Matt Newell, City Engineer <br /> Peter Brinkoetter, ADM <br /> Michelle Bublitz, ADM <br />
