[' <br /> ENVIRONMENTAL CONSULTING & PROJECT MANAGEMENT <br /> SERVICE AGREEMENT <br /> BETWEEN <br /> CITY OF DECATUR <br /> AND <br /> BODINE ENVIRONMENTAL SERVICES, INC. <br /> Bodine Environmental Services, Inc.; 5350 East Firehouse Road, Decatur, Illinois 62521 <br /> (BODINE) and the City of Decatur, One Gary Anderson Plaza, Decatur, Illinois 62523 <br /> (CLIENT) agree that BODINE shall provide environmental consulting services and applicable <br /> project management services in association with the Decatur Brownfields Grant. <br /> 1.0 SCOPE OF SERVICES <br /> 1.1 BODINE shall endeavor to provide the CLIENT with consulting services, vehicles, <br /> equipment, labor and materials necessary to consolidate wastes, obtain waste <br /> characterization samples, obtain waste profile acceptance at a permitted disposal or <br /> treatment facility, prepare correspondence, compliance commitment agreements, focused <br /> site investigation plans and limited remedial action work plans as requested by the <br /> CLIENT and the Illinois Environmental Protection Agency. <br /> 1.2 BODINE shall provide the services as outlined in Attachment 1, Scope of Work. <br /> 1.3 BODINE shall provide draft documents to the CLIENT for review and modification prior <br /> to submission to the Illinois Environmental Protection Agency. <br /> 1.4 CLIENT shall make all provisions for BODINE to enter upon public and private property <br /> as required for BODINE to perform services under this Agreement. <br /> 1.5 The CLIENT shall give prompt notice to BODINE whenever CLIENT observes or <br /> otherwise becomes aware of any development that affects the scope or timing of ' <br /> BODINE's services. <br /> 1.6 BODINE is obligated to comply with the requirements of the OSHA Hazard <br /> Communication Standard 29 CFR 1910.1200. As such, the CLIENT shall provide to <br /> BODINE a MSDS for any toxic substances believed by the CLIENT to be within the <br /> work area which poses a known or suspected health or physical hazard. BODINE may <br /> rely upon the data provided by the CLIENT regarding said toxic substances in making <br /> decisions and judgements as to the manner in which it shall perform, and in taking <br /> precautions as to prevent injury or illness to one of its employees or any other person <br /> with access to the work area. Any inaccuracies in said data that proximately causes an <br /> injury or illness to an employee of BODINE to any other person within the work area, <br /> and any liability resulting therefrom, shall not inure BODINE, except, to the extent that <br />
