<br /> Under Insight's proposal even if the City were to lawfully
<br /> ternunate the Ordinance the City would be prevented from
<br /> mandating that facilities be removed from the right-of-way.
<br /> It is the City's position that if a franchise is lawfully
<br /> terminated Insight no longer has any authority to occupy the
<br /> rights-of-way and its facility must be immediately removed..
