AGREEMENT FOR WATER SERVICE
<br /> This Agreement for Water Service is made thi��' ctay of , 2006,
<br /> between Eddie L. Morgan and J. Arlene Morgan, husband and wife .O. Box 16, 1575 West
<br /> Elwin Road, Elwin, IL 62532 (hereinafter "Owner") and the City o Decatur, Illinois, a
<br /> municipal corporation, One Gary K. Anderson Plaza, Decatur, IL 62523 (hereinafter "City").
<br /> WHEREAS, Owner owns certain real estate located at 1582 West Elwin Road, located in
<br /> Elwin, South Wheatland Township, Macon County, Illinois, and legally described on the Plat of
<br /> Survey attached hereto as Exhibit "A" (hereinafter "Property"); and
<br /> WHEREAS, the Property does not front onto an existing water main,but Owner and City
<br /> are in agreement that Owner shall be allowed to have constructed and installed a water main
<br /> extension(hereinafter "Water main Extension") to service the Property, subject to the terms and
<br /> conditions of this Agreement.
<br /> NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth
<br /> in this Agreement for Water Service, Owner and City agree as follows:
<br /> 1. Owner hereby submits an accurate legal description for the Property to which the
<br /> water service is to be extended, said legal description contained on the Plat of Survey dated
<br /> January 10, 2006, prepared by William C. Faulkner, Registered Land Surveyor, and attached
<br /> hereto as Exhibit "A." The Property is located at 1582 West Elwin Road, Elwin, Illinois 62532,
<br /> but the address of the Property under the enhanced 911 Emergency Telephone System installed
<br /> in Macon County is 1582 West Elwin Road, Decatur, IL 62521, as per a copy of the July 9,
<br /> 2001 correspondence from Daniel W. Sanner, Director of Macon County Emergency Telephone
<br /> System Board, attached hereto as Exhibit "B."
<br /> 2. The Property shall be annexed to the City if it is contiguous to the City or when it
<br /> becomes contiguous to the City. At such time that it becomes contiguous to the corporate limits
<br /> of the City, the Owner of said Property shall,within ninety(90) days after receiving notice from
<br /> the City, petition to annex to the City. If a petition is not received within the time period, or the
<br /> property is not annexed as a result of the petition, water service will be immediately terminated
<br /> without further notice.
<br /> 3. In accordance with Owner's desired construction and installation schedule as
<br /> Owner may agree with Owner's contractor, Owner may proceed to have constructed and installed
<br /> a new 8" ductile iron water main extension from the existing City of Decatur 12" water main
<br /> located along the east side of Taylor Street, Elwin, Illinois, running west through or under Taylor
<br /> Street and North Street approximately 217'west, all as more particularly described and depicted
<br /> on the Water Main Plan, prepared by Steven M. Baumann, P.E., On Site Engineering, LLC, a
<br /> copy attached hereto as Exhibit "C." The City, at its option,may install or have installed a fire
<br /> . hydrant at the west end of said water main extension, approximately 217'west of the existing
<br /> main, all as more specifically depicted on the Water Main Plan, attached hereto as Exhibit "C,"
<br /> and in accordance with further terms pertaining to the option of the City to install a fire hydrant,
<br /> as set forth in Paragraph 10 of this Agreement.
