JACKSON to rezone <br /> 2110 and 2120 East Pythian Avenue from R-2, Single <br /> Family Residence District to B-2 Commercial District. <br /> Mrs. Joselyn Stewart was sworn in by Ms. Jesse. <br /> Mrs. Stewart gave the recommendation of staff: <br /> The petitioner owns and operates the World of Power Sports at 2635 North 22nd Street. <br /> The business sells motorcycles, all-terrain vehicles, ski boats and other motor-driven <br /> sport vehicles. The petitioner owns Lots 15 and the north 182 feet of Lot 16 on Pythian <br /> Avenue. <br /> On January 10, 2002, the owners requested a variance to allow for the expansion of the <br /> parking area onto the adjacent residentially-zoned property. The petitioners were advised <br /> that such a variance would only allow parking on the lot, and that the requested storage <br /> would be allowed only if the property were rezoned. The petitioners opted to proceed <br /> with the variance, in order to begin construction of the pazking lot while the weather <br /> remained warm. The variance was granted by the Zoning Board of Appeals. <br /> The petitioner proposed rezoning 2071 and 2117 East Damon and 2120 and 2110 East <br /> Pythian to enable the expansion of the existing customer and employee parking azeas and . <br /> to construct a new product storage yard in order to meet the needs of his expanding <br /> business. Currently, the main parking area for the World of Power Sports is on the east <br /> side facing 22nd Street. To accommodate this expansion, the petitioner proposed paving <br /> Lots 31 and 32. The petitioner also proposed to demolish the structures on Lot 32. At <br /> that time, the petitioner had no plans for Lots 15 and 16. <br /> At the February 18, 2002, the City Council approved the rezoning of 2071 and 2117 East <br /> Damon Avenue. During the February 5, 2002 City Plan Commission, the petitiorer <br /> withdrew his request to rezone Lot 15 and the north 182 feet of Lot 16 on Pythian <br /> Avenue (2120 and 2110 East Pythian Avenue). <br /> The petitioner proposes to rezone 2120 and 2110 Pythian Avenue from R 2, Single <br /> Family Residence to B-2, Commercial District to allow for the construction of a building <br /> to handle their shipping operations for their expanding business. <br /> A buffer yard between ten (10) and fifty (50) feet (ten percent of the frontage) must be <br /> provided adjacent to residential districts. <br /> The Decatur Urban Area Land Use Plan depicts the neighborhood of this petition as a <br /> residential pocket in the heart of an industrial area. Over the years, residentially zoned <br /> lots in the azea have been rezoned to commercial and industrial permitted zonings. <br /> Ordinarily, staff would oppose such a lot-by-lot encroachment into an established <br /> neighborhood. Prior rezoning approvals have changed the nature and land uses along <br /> Pythian Avenue as well as Damon Avenue. Lot 15 (2120 East Pythian Avenue) is now <br /> surrounded on the north, east, and south by either commercial or industrial zoning; <br /> therefore, staff is not opposed to the rezoning of Lot 15 as it is now compatible with <br /> adjacent zonings. <br />
