OxDn�alvcE No. 2005-79 <br /> AN ORDINANCE AUTHORIZING THE ISSUANCE OF NOT TO EXCEED <br /> $75,000,000 ILLINOIS FINANCE AUTHORITY AND CITY OF DECATUR, <br /> MACON COUNTY, ILLINOIS, FIRST HOME: ILLINOIS FIXED RATE <br /> SINGLE FAMILY MORTGAGE REVENUE BONDS; AUTHORIZING THE <br /> EXECUTION AND DELIVERY OF AN ORIGINATION AND SERVICING , <br /> AGREEMENT, INTERGOVERNMENTAL AGREEMENT, INDENTURE OF <br /> TRUST, SUPPLEMENT TO ORIGINATION AGREEMENT AND <br /> INDENTURE, COMPLIANCE AGREEMENT, TAX EXEMPTION � <br /> CERTIFICATE AND AGREEMENT, BOND PURCHASE AGREEMENT AND � <br /> CONTINUING DISCLOSURE AGREEMENT; AUTHORIZING THE <br /> DISTRIBUTION OF AN OFFICIAL STATEMENT OR OTHER DISCLOSURE <br /> DOCUMENT IN CONNECTION WITH THE BONDS; APPROVING TF� <br /> DISTRIBUTION OF AN INVITATION TO PARTICIPATE TO LENDERS AND <br /> THE FORM THEREOF; APPROVING TI� FORM OF OFFER TO ORIGINATE <br /> AND SELL MORTGAGE LOANS;AND RELATED MATTERS. <br /> WHEREAs, the City of Decatur, Illinois (the "City") is a home rule unit of government <br /> pursuant to Section 6(a) of Article VII of the 1970 Constitution of the State of Illinois and as <br /> such, may exercise any power or perform any function pertaining to its government and affairs; <br /> and <br /> WxEREAs, pursuant to the Constitution and the laws of the State of Illinois, particularly <br /> its home rule powers and the Intergovernmental Cooperation Act, 15 ILCS 220/1 et. seq., the <br /> City is authorized to issue its revenue bonds jointly with the Illinois Finance Authority (the <br /> "Authority") to aid in assisting qualified persons or families in acquiring homes within the State <br /> of Illinois by providing a source of mortgage financing, including down payment assistance (the <br /> "Program"), which constitutes a valid public purpose for the issuance of revenue bonds by the <br /> Authority and the City; and <br /> WxEREAs, the Authority and the City (collectively, the "Issuers") have agreed to jointly <br /> issue their tax-exempt revenue bonds to finance the Program; and <br /> WHEREAS, it is now necessary, desirable and in the best interests of the City to authorize <br /> the execution and delivery of an Indenture of Trust (the "Indenture") between the City, the <br />
