Excerpts of Decatur City Plan Commission Meeting August 4, 2005 <br /> Cal.No. OS-33 Petition of MIKE OSBORNE to rezone 805-845 <br /> North Main Street from R-6, Multiple Dwelling <br /> District and B-1,Neighborhood Shopping District <br /> to B-2 Commercial District. <br /> Ms. Kathy Miller was sworn in by Ms. Jesse. <br /> Ms. Miller gave the recommendation of staff: <br /> The subject site is located on the west side of the 800 Block of North Main Street <br /> containing approximately 36,000 square feet. The property is currently developed with a <br /> used caz lot and a vacant lot. The used car lot has been at this location for several years. <br /> The City has requested the petitioner to rezone to be in compliance with the zoning <br /> ordinance for used auto sales. <br /> The petitioner proposes to construct an electronic messaging sign at the site. The sign <br /> must be located five(5)feet from the property line,be no more than 100 square feet and <br /> no taller than 35 feet in height. <br /> The surrounding zoning includes R-6 Multiple Dwelling District, al Office District, B-1 <br /> Neighborhood Shopping District and B-2 Commercial District. The Decatur Urban Area <br /> Land Use Plan shows the east half of the block as Commercial. The proposed rezoning <br /> to B-2 Commercial District is compatible with the adjacent surrounding mixed zoning in <br /> the area. Adjacent property values will not be diminished with the rezoning. <br /> Based on the above analysis, staff recommends approval of the petition as submitted with <br /> the following conditions: <br /> 1. A site plan including landscaping and lighting will be required for any additional <br /> pazking lot paving at the site. <br /> 2. A building permit for the parking lot is required. <br /> 3. A sepazate permit for the sign is required. <br /> Section XXIX. requires the Plan Commission to hold a public hearing on a rezoning <br /> request and then forwazd its report and recommendation to the City Council for final <br /> approval. A motion to forwazd Calendaz Number OS-33 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. Tom Smith questioned whether the corridor plan was still a viable plan and does Cal. <br /> No OS-33 work into this plan. <br /> Ms. Miller stated that with the submittal of a site plan, the site will be in compliance with <br /> the Zoning Ordinance which should meet the intent of the corridor plan. <br />
