Staff finds the proposed amendment to be consistent with the goals of the Decatur
Zoning Ordinance and the approved Planned Unit Development. Based on the
previous analysis, staff recommends approval of the petition with one condition:
a. A site, landscaping and lighting plans must be submitted to and approved by the
Department of Economic and Urban Development and the Department of
Engineering and Infrastructure before building permits are issued.
A motion to forward Calendar Number OS-41 to City Council with a recommendation for
approval is advised.
Mr. Anderson questioned whether the petition was just for an additiona1500 feet. Ms.
Stickle stated that was correct.
Mr. Robert Krimmel, representative for petitioner, was sworn in by Ms. Jesse.
. Mr. Krimmel stated that Dr. Sinha needed additional space for patient examining rooms
and would appreciate the City Plan Commission approving this request.
Mrs. Susie Peck asked whether there were any objectors.
Ms. Susan Parry, 2 Montez Drive, was sworn in by Ms. Jesse.
Ms. Parry stated she was a neighbor and her living room and kitchen faces the Doctor's
office. Ms. Parry was concerned with the landscaping and lighting and was interested in
hearing exactly what those plans might be. Ms. Parry stated that previously when the
original building was built, she did not feel the landscaping was done the way it was
originally planned. Ms. Pany stated she would just like to be assured that what ever the
plan called for it would be completed according to the plan.
Mr. Tom Smith questioned staff as to what assurance could be given to Ms. Pany. Ms.
Miller stated a site plan will need to be approved and it will be inspected once the work is
complete.
Ms. Stickle stated in 1997 when the original petition was approved there was not a
landscaping ordinance. With the approval of the new petition,it will have to comply.
Dr. Sushant Sinha, petitioner, was sworn in by Ms. Jesse.
Dr. Sinha stated he felt he has been a good neighbor and has cooperated with what the
neighbors wanted.
