Mille , AICP, Senior Planner �jy` SUBJECT: Alley Way Vacation between East Eldorado and East Ceno Gordo Streets, west of North Jasper Street SIJIVIlVIAI[ZY RECOMMENDATION: Staff recommends approval of the alley vacation. Since the public right of way does not appear necessary to serve the general public, staff is of the opinion that the best interests of the City of Decatur would be served by approving the alley vacation and reserving an easement for utility maintenance in the north alley. The Plan Commission reviewed the request at the May 5, 2005 meeting and recommended approval with a vote of 9 to 0. Plan Commission minutes aze attached. BACKGROUND: In the late 1970's, the city, the state and the federal government jointly improved the Jasper and Eldorado Streets intersection. Advance Auto proposes to construct a retail auto parts store on the tract of property located between Eldorado, Jasper and Illinois Streets. The north alley and the adjacent right-of-way is required for the tract to meet the Zoning Ordinance requirements for developing the retail store(building and parking lot setbacks). Prairieland Development owns all of the property adjacent to the right of way. The State of Illinois owns right-of-way adjacent to the parcel; the developer is in the process of purchasing the extra right-of-way from the state. POTENTIAL OBJECTIONS: There were no objectors to the alley vacation at the Plan Commission meeting. 1NPUT FROM OTHER SOURCES: Utility letters have been received: an easement for utility access and maintenance will be required in the north alley. BUDGET/TIME IMPLICATIONS: An appraisal for the area to be vacated was submitted with an estimated market value of$1600. The petitioner will pay the City $1600 for the property to be vacated.
