Mille , AICP, Senior Planner �jy` <br /> SUBJECT: Alley Way Vacation between East Eldorado and East Ceno Gordo Streets, west of <br /> North Jasper Street <br /> SIJIVIlVIAI[ZY RECOMMENDATION: Staff recommends approval of the alley vacation. Since <br /> the public right of way does not appear necessary to serve the general public, staff is of the <br /> opinion that the best interests of the City of Decatur would be served by approving the alley <br /> vacation and reserving an easement for utility maintenance in the north alley. The Plan <br /> Commission reviewed the request at the May 5, 2005 meeting and recommended approval with a <br /> vote of 9 to 0. Plan Commission minutes aze attached. <br /> BACKGROUND: In the late 1970's, the city, the state and the federal government jointly <br /> improved the Jasper and Eldorado Streets intersection. Advance Auto proposes to construct a <br /> retail auto parts store on the tract of property located between Eldorado, Jasper and Illinois <br /> Streets. The north alley and the adjacent right-of-way is required for the tract to meet the Zoning <br /> Ordinance requirements for developing the retail store(building and parking lot setbacks). <br /> Prairieland Development owns all of the property adjacent to the right of way. The State of <br /> Illinois owns right-of-way adjacent to the parcel; the developer is in the process of purchasing the <br /> extra right-of-way from the state. <br /> POTENTIAL OBJECTIONS: There were no objectors to the alley vacation at the Plan <br /> Commission meeting. <br /> 1NPUT FROM OTHER SOURCES: Utility letters have been received: an easement for utility <br /> access and maintenance will be required in the north alley. <br /> STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at <br /> 424-2786 or at kjmiller@decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: An appraisal for the area to be vacated was submitted with <br /> an estimated market value of$1600. The petitioner will pay the City $1600 for the property to <br /> be vacated. <br />
