4
Excerpts of Decatur City Plan Commission Meeting, May 5, 2005
Cal. No. OS-20 Petition of PRAIRIELAND DEVELOPMENT to vacate
the alleys located between the 1100 Blocks of East '
Eldorado Street and East Cerro Gordo Street. I
Ms. Kathy Miller was swom in by Ms. Jesse.
Ms. Miller gave the recommendation of staff:
In the late 70's, the Jasper and Eldorado Streets intersection was improved with two one
way couples running two blocks north and south of Eldorado Street. Advance Auto
proposes to construct a retail auto parts store on the tract of property located between the
couples. The north alley (on the proposed tract) and the adjacent right-of-way is required
for the tract to meet the Zoning Ordinance requirements for developing the retail store
(building and parking lot setbacks) as the site has four front yard.
Utility letters have been received stating agreement with the proposed vacation. An
easement will be reserved for utility access in the north alley.
Prairieland Development owns all the property adjacent to the right of way. The State of
Illinois owns right-of-way adjacent to the pazcel; the developer is in the process of
purchasing the extra right-of-way from the state.
An appraisal was submitted by the petitioner with an estimated marlt value of$1,600
($0.45 per square foot) for both alleys. A second appraisal is not required. The petitioner
will pay the City of Decatur$1600 for the vacated alleys.
Staff is of the opinion that the best intrests of the City of Decatur would be serd by
approving the request to vacate the alley right of ways. Staff recommends approval of
the petition.
The Administrative Policy of the City of Decatur requires that property vacation requests
be submitted for a public hearing. Although a Plan Commi$ion recommendation is not
required, a motion to forward the request of Cal. No. OS-20 to the City Council with a
recommendation of approval is suggested. -
Mr. Steve Kuper, representative for the petitioner, was sworn in by Ms. Jesse.
Mr. Kuper stated that a one story building was being proposed for an auto parts business.
There were no objectors present.
