. > � � <br /> 3. a vehicle in a place obstructing either vehicle or pedestrian traffic, <br /> 4. a vehicle in a place violating emergency snow routes, <br /> 5. a vehicle herein defined and specifically found to be a nuisance <br /> because of the hazard created by its condition or location to other tra�c or <br /> pedestrians because of its physical condition or its position in relation to <br /> public right of ways: <br /> a) a vehicle parked on a public right-of-way covered by a <br /> tarp or other covering which obscures reflective devices, <br /> b) a vehicle containing garbage, debris or hazardous <br /> materials, <br /> c) a vehicle in such a state of deterioration that it poses an <br /> immediate threat to the public health, safety, and welfare, includ- <br /> ing, but not limited to a current state of disrepair from deposited <br /> harmful materials or substances upon the street including, but not <br /> limited to glass, oil, transmission or brake fluids or other such <br /> substances or the placing of a vehicle on blocks, jacks or other <br /> elevating device posing a threat to the public health, safety and <br /> welfare. <br /> A vehicle found to be on the public right-of-way in violation of this section shall be subject to <br /> immediate removal and towing pursuant to Section 38 (A)(ii)of this Chapter. <br /> E. Except where necessary to avoid conflict with other traffic, or in <br /> compliance with law or the directions of a police oi�icer or official traffic control <br /> device, no personal shall stop, stand, leave or park any vehicle in a public pazking <br /> azea or on a City street or alley if the vehicle does not display a current annual <br /> registration sticker or temporary permit pending registration. <br /> . . <br /> 38 A. (ii} <br /> (ii) A police officer may remove or cause to be removed a vehicle as <br /> authorized herein without notice to the owner thereof whenever such vehicle is <br /> parked or abandoned so as to constitute an immediate hazard or obstruction to <br /> other vehicles on or seeking access to public streets or alleys, or so as to prevent <br /> or hinder repair to, or ma.intenance o� streets or alleys with temporary parking <br /> restrictions for that purpose, provided that notice as required in subpazagraph (i) <br /> hereof is given to such owner, if the same can be ascertained, within 24 hours of <br /> such removal or if a vehicle is parked or located on public streets, alleys or right- <br /> of-ways in violation of Section 35 (D) of this Chapter.
