ECONOMIC AND URBAN DEVELOPMENT MEMORANDUM
Memo No. 04-141
September 14, 2004
TO: Honorable Mayor Paul Osborne and City Council
FROM: Steve G , City Manager ^/
Dane C. , AICP, Assistant City Managef
Kathy J. Mi er, AICP, Senior Planner C,r1'1,
Greg C. Crowe, Economic Development CoordinatorG
SUBJECT: Request to rezone Spring Creek Plaza to B-2 Commercial District
SUMMARY RECOMMENDATION: Staff recommends denial of the petition to rezone the
premises from R-1 Single Family Residence, to B-2 Commercial District, based on the following
factors:
1. Based on the prior development of property at this intersection as planned unit
developments, the subject property should be developed in the same manner;
2. The allowable uses in the B-2 district may permit types of uses that are inappropriate in the
context of the surrounding developments, such as automobile sales, gasoline stations, etc.
3. Because the site is a candidate for redevelopment, it is likely that variation from the
development standards of the Zoning Ordinance will be necessary; therefore, any
redevelopment considerations are best handled under a unified site plan. Such variations
that may be required include provisions for signage, setbacks, landscaping and lighting.
The petitioner has stated that the establishment of a planned unit development on the site will preclude
its redevelopment. Staff would point out that the B-3 Planned Unit Development process has been
used for several similar shopping centers in Decatur, including Wal-Mart North, Circuit City Plaza,
Mound Center and Brettwood Village. Two redevelopment P.U.D.'s include the Fairview Plaza center
and the Osco Drug facility (former Black's Hardware) located immediately east of Spring Creek
Plaza. The City Plan Commission voted 6-3 with one abstaining to approve the petition at the
September 2, 2004 meeting. The minutes of the meeting are attached.
Staff is of the opinion that the optimal zoning for the site is B-3 Planned Shopping Center District.
BACKGROUND: The petitioner is requesting the rezoning of the approximately 9.6 acre property to
B-2 Commercial District to redevelop the site. The property has operated under a court ordered special
use permit since 1976 as a B-1 Neighborhood Shopping Center excluding gasoline filling stations.
Buildings on the site include a strip mall housing Walgreens, Perkins Restaurant, a doctor's office, a
bank and small retail sho s. The surroundin zonin includes R-1 Sin le Famil Residence O-1
P g g g Y ,
Office P.U.D., B-1 Neighborhood Commercial, B-2 Commercial and B-3 Planned Shopping Center.
