Excerpts of Plan Commission Meeting of August 5, 2004 <br /> Cal. No. 04-39 Petition of FIRST CHURCH OF THE NAZARENE to <br /> vacate the subdivision plat between 1235 to 1255 West <br /> Hickory Point Road. <br /> Ms. Stickle was sworn in by Mrs. Althoff: <br /> Ms. Stickle gave the following recommendation of staff: <br /> The petitioner owns the property to be vacated as well as the abutting property to the <br /> south. There are no utilities in the area to be vacated. The petitioner had planned to <br /> utilize the three lots to finance church development and has since determined that it is no <br /> longer necessary. <br /> The petitioner is requesting the vacation of the approximately 2.7 acres located at 1235, <br /> 1245 and 1255 West Hickory Point Road. The petitioner would like to vacate the plat to <br /> create one large lot on which the church resides. <br /> The original fifteen (15) foot easement recorded at time of plat will be required to remain <br /> as recorded. The forty (40) foot right-of-way dedicated to the City will remain as <br /> recorded. An appraisal for the vacation was not required because the petitioner owns the <br /> area to be vacated. The vacation of the plat will not have an adverse affect on the general <br /> public. <br /> The plat is not necessary to serve the general public. Staff recommends approval of the <br /> plat vacation petition subject to the following condition: <br /> A. The original fifteen (15) foot easement recorded at time of plat will be required to <br /> remain as recorded. <br /> B. The forty (40)foot right-of way dedicated to the City will remain as recorded. <br /> A motion to forward Cal. No. 04-39 to the City Council with a recommendation of <br /> approval is suggested. <br /> There were no objectors present. <br /> It was moved and seconded (Dunn, Anderson) to forward Cal. No. 04-39 to the City <br /> Council with the recommendation for approval as submitted by petitioner. Motion <br /> carried unanimously. <br />
