Stewart, Transportation Planne�� <br /> SUBJECT: Request to rezone property from R-2, Single Family Residence District to B-2, <br /> Commercial District at 2778, 2788, and 2798 North 22nd Street I, <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the petition as proposed. <br /> Staff finds the proposal to be compatible with the adjacent uses in the area as well as the Decatur <br /> Urban Area Land Use Plan. The City Plan Commission voted 10-0 to recommend approval of this <br /> petition at the July 1, 2004 meeting; the minutes of the meeting are attached. <br /> BACKGROUND: On November 6, 2003 the City Plan Commission voted 5-2 to deny a rezoning of <br /> .75 acres (32,580 square feet) for a used car lot at 2778 North 22nd Street. The rezoning was reviewed <br /> by City Council on November 17, 2003 where it was tabled on a 5-2 vote. <br /> It was the decision of council to give the property owner six(6)months to try to acquire additional land <br /> for his used car lot business. Since this decision,the property owner has acquired two additional lots. <br /> The current proposal contains 1.81 acres (78,741 square feet). Lots Two (2) and Three (3) are currently <br /> vacant and undeveloped while Lot One(1)contains a single family residence on the site. <br /> The petitioner proposes to rezone three lots totaling 1.81 acres, to B-2 Commercial District. The <br /> petitioner has indicated the property will be used for a used automobile sales business, paving the lot to <br /> hold 20-30 cars an office and a garage.
