� � ' � . , Hookm 3855 aage : 451 <br /> FAC�ADE AGREEMENT <br /> This Agreement, made this 17th day of October, 2005, between Olde Towne <br /> Development, LLC (hereinafter referred to as "Owner"), and the City of Decatur, Illinois <br /> a municipal corporation (hereinafter referred to as "City"), <br /> WITNESSETH: <br /> Whereas, a portion of the City of Decatur, Illinois, know as the Downtown <br /> Historic District has been designated by the City as an area of architectural and <br /> historical significance, and property located within this District may be a part of the Old <br /> Towne Redevelopment (TIF) Project and; <br /> Whereas, Owner represents that it is the record owner of the improved real <br /> estate located with the District or Project Area, commonly know as 101 E. Prairie, <br /> Decatur, Illinois, and legally described as: <br /> Lots One (1), Two (2), Three (3), Four (4) and Five (5) in Block <br /> One (1) of Franklin Priest's Resurvey of Lots Five (5), Six (6) and Seven <br /> (7) in Block Two (2) of the Town of Decatur, as per Plat recorded in Book <br /> U, Page 317 of the Records in the Recorder's Office of Macon County, IL, <br /> and also a tract six (6) feet in width lying west of and adjoining said Lots <br /> 1, 2, 3, 4, and 5 in Macon County, Illinois. Situated in Macon County <br /> (hereinafter referred to as the "property") and; <br /> Whereas, Owner and City desire to restore, maintain, and preserve the exterior <br /> design and facade of the improvement situated on the property, and City desires to <br /> provide funds for approved exterior design and facade restoration from funding <br /> available through the Community Development Block Grant (CDBG) program of the <br /> United States Department of Housing and Urban Development, and; <br /> Whereas, City agrees to provide funds for renovation work to the exterior design <br /> and facade of the building, subject to the financial limitations set forth herein and the <br /> CDBG Program guidelines established by HUD, and; <br /> Whereas, Owner agrees to renovate the exterior design and facade of the <br /> building in accordance with the terms of this agreement, CDBG guidelines and Owner's <br />
