That the undersigned will not rent the Residence or use the Residence as an <br /> investment property or as a recreational or a"second"home. <br /> 9. That neither the undersigned, nor any party related to the undersigned, has entered <br /> into any agreement with the Seller or any developer; contractor or any other person pursuant to <br /> which the undersigned has agreed to pay consideration, either in cash ar in kind, in excess of the <br /> purchase price for the Residence or pursuant to which any portion of the Residence has been left <br /> unfinished or any fixtures or other architectural appointrnents have been omitted or removed from <br /> the Residence in order to reduce the purchase price. <br /> 10. That the undersigned has not been a party to a conditional sales contract, pledge, <br /> agreement to hold title in escrow or any other form of owner fmancing(whether or not paid in full) <br /> on the Residence at any time prior to the execution of this Affidavit. <br /> 11. That the undersigned will not use any portion of the proceeds of the HOME Loan to <br /> replace an existing mortgage under which the undersigned may be obligated. <br /> 12. That the purchase price of the Residence and any improvements purchased in <br /> connection therewith, including any attached items such as carpeting, curtain rods and light <br /> fixtures, but exclusive of any settlement or financing costs or any amount paid for property which <br /> is not real properiy or a fixture, is $ . That the undersigned has read the note evidencing the HOME Loan and <br /> understands that: (a)the HOME Loan is being funded by the Sponsor from federal funds provided <br /> through the HOME Program; (b)the terms of the HOME Loan are available only to persons with a <br /> family income not in excess of HOME Program guidelines; (c)the undersigned's interest in the <br /> Residence may be adversely affected if(i)this Affidavit or any other affidavits ar certificates given <br /> in connection with the making of the HOME Loan are untrue; (ii)the undersigned leases or rents <br /> the Residence to another; or(iii)the undersigned causes an assumption of the HOME Loan without <br /> prior written approval from the Sponsor. <br /> 15. That the undersigned hereby authorizes the Sponsor to conduct such investigations <br /> as it deems necessary to ascertain the truth and correctness of the statements made in this Affidavit, <br /> and the undersigned hereby agees to provide such information as the Sponsor shall reasonably <br /> request for such purpose. <br /> C-2 <br />
